America's sales tax system unfairly favors online retailers - who are not required to collect sales tax on most sales - at the disadvantage of brick-and-mortar merchants. With sales tax amounting to 10 percent, or more, in some areas, Main Street retailers are seeing increased evidence that their customers are buying online in order to avoid the tax. It's time to level the playing field so all retailers - no matter which channel they sell in - can remain competitive. o Smart Healthcare Reform- On June 28, 2012 the U.S. Supreme Court ruled that the Affordable Care Act (the new health care law) is constitutional, including the individual mandate.Check out these short graphs and summaries NRF has compiled to explain what issues retailers need to consider when implementing the new law.

o Tax Reform- Retail benefits from few of the tax breaks that other industries do and pays the highest effective corporate tax rate of any sector of the U.S. economy. The retail industry would see significantly lower tax bills under proposals to 'broaden the base' by eliminating most deductions and credits and to use the tax revenue that would be recovered to lower rates for all businesses. o Swipe Fee Reform- There has been a recent $7.25 billion proposed settlement of a federal antitrust lawsuit brought by a group of retailers against Visa and MasterCard. While NRF was not a party to the lawsuit and does not have an official position on the settlement itself, we are working closely with member companies to exam it to determine next best steps.
